1. Scope and Contractual Basis

These terms and conditions of sale apply to purchases of goods through the online store www.hundpahavna.no, operated by Hund På Havna Brunes (the “Seller”).

These terms and conditions govern the contractual relationship between the Seller and the buyer in consumer purchases. A consumer purchase means a purchase in which the buyer is a natural person acting primarily outside the scope of their trade, business, craft or profession, and the Seller is acting in the course of business. The purchase agreement consists of the information displayed in the Online Store at the time of ordering, any written correspondence between the parties, the order confirmation, and these terms and conditions of sale. In the event of any conflict, mandatory legislation shall prevail over these terms and conditions of sale. Thereafter, specific information provided during the ordering process or in direct written correspondence shall prevail over the general terms and conditions of sale.

These terms and conditions of sale do not limit any rights held by the buyer under mandatory Norwegian law.

3. Products and Product Information

The Seller endeavours to ensure that product information, images, prices and stock availability in the Online Store are accurate and up to date. Images are illustrative, and minor variations in colour, size, packaging, pattern and other visual characteristics may occur as a result of display settings, production changes or supplier-related circumstances.

Information concerning the essential characteristics of a product is provided on the relevant product page. The buyer is responsible for determining whether the product is suitable for its intended purpose before placing an order.

The Seller reserves the right to correct obvious typographical errors, pricing errors, technical errors and inaccurate product information. Where an error is of such a nature that the buyer understood, or ought reasonably to have understood, that the information was incorrect, the Seller shall not be bound by the incorrect information.

 

4. Prices and Costs

All prices in the Online Store are stated in Norwegian kroner (NOK) and include value-added tax, unless expressly stated otherwise.

Shipping costs and any other applicable charges will be disclosed during the ordering process before the buyer completes the order. The buyer shall not be charged costs that were not disclosed before the contract was concluded.

The Seller may amend prices in the Online Store without prior notice. Price changes shall not affect orders that have already been accepted by the Seller.

 

5. Orders and Formation of Contract

The buyer places an order by adding items to the shopping cart, providing the necessary information and completing the order through the Online Store’s payment solution.

An order placed by the buyer shall be regarded as an offer to purchase. An automatically generated receipt or order confirmation documents that the order has been received, but does not in itself constitute acceptance of the order by the Seller.

The contract becomes binding when the Seller sends a separate confirmation that the order has been accepted, normally in the form of a dispatch confirmation or other express acceptance.

The Seller may reject or cancel an order if:

- the item is unavailable;
- there is an obvious error in the price, product information or stock availability;
- the Seller has objective grounds to suspect misuse, fraud or improper use of the payment solution; or
- the order cannot otherwise be completed for other objective reasons.

If the Seller is unable to deliver all or part of an order, the buyer shall be notified without undue delay. Any amount paid for goods that cannot be delivered shall be refunded without undue delay.

 

6. Payment

Payment shall be made using the payment methods available in the Online Store from time to time.

For card payments, the purchase amount may be reserved when the order is placed. The amount will normally be charged when the goods are dispatched, unless otherwise provided by the selected payment solution or expressly agreed. For invoice or instalment-payment solutions, the payment provider’s own terms may apply. The buyer is encouraged to review such terms before selecting a payment method.

The Seller does not process card details beyond what is necessary to complete the payment. Payment information is handled by authorised payment providers.

 

7. Delivery

The Seller delivers to the areas and by the shipping methods displayed in the Online Store at the time of ordering. Delivery shall be made to the delivery address provided by the buyer. The buyer is responsible for ensuring that their name, address, telephone number and other delivery information are accurate and complete.

Any stated delivery time is indicative, unless a specific delivery date has been expressly agreed. If no delivery time is stated, the goods shall be delivered without undue delay and no later than 30 days after the contract was concluded, cf. the Norwegian Consumer Purchases Act.

If delivery is delayed, the Seller shall inform the buyer as soon as possible. The buyer’s rights in the event of delay are governed by the Norwegian Consumer Purchases Act.

 

8. Risk and Uncollected Parcels

Risk in the goods passes to the buyer when the buyer, or a person designated by the buyer, has taken physical possession of the goods.

If a parcel is not collected and is returned to the Seller, the Seller may claim reimbursement for necessary, actual and documented costs incurred as a result, to the extent permitted under Norwegian law.

 

9. Right of Withdrawal

As a general rule, the buyer has the right to withdraw from the contract without giving any reason, cf. the Norwegian Right of Withdrawal Act.

The withdrawal period is 14 days from the date on which the buyer, or a person designated by the buyer, receives the goods. In the case of delivery of several goods in the same order, the period runs from receipt of the final item.

To exercise the right of withdrawal, the buyer must provide the Seller with a clear notice before the withdrawal period expires. Notice may be sent by email to post@pataljanis.com. The buyer may also use the standard withdrawal form, available here: **[insert link]**.

The buyer shall return the goods without undue delay and no later than 14 days after sending notice of withdrawal. The buyer bears the cost of return, unless the Seller has expressly stated otherwise or the goods are defective.

Where the right of withdrawal is exercised, the Seller shall refund all payments received from the buyer, including the cost of standard delivery. If the buyer has expressly chosen a delivery method more expensive than the least expensive standard delivery offered by the Seller, the additional cost shall not be refunded.

The refund shall be made without undue delay and no later than 14 days after the Seller received notice that the right of withdrawal is being exercised. However, the Seller may withhold the refund until the goods have been returned or the buyer has provided documentation that the goods have been sent back, whichever occurs first.

The buyer is liable only for any reduction in value resulting from handling of the goods beyond what is necessary to establish their nature, characteristics and functioning.

The right of withdrawal is subject to the limitations and exceptions set out in the Norwegian Right of Withdrawal Act.

 

10. Complaints and Defects

If the goods are defective, damaged upon delivery, or do not correspond to the order, the buyer must notify the Seller within a reasonable time after the defect was discovered or ought to have been discovered. A complaint made within two months after the defect was discovered or ought to have been discovered shall always be deemed timely. Complaints may be submitted to post@pataljanis.com.

The buyer’s rights in the event of defects are governed by the Norwegian Consumer Purchases Act. Depending on the circumstances, these may include the right to repair, replacement, a price reduction, termination of the purchase and/or compensation.

A complaint must be made no later than two years after the buyer took possession of the goods. If the goods, or parts thereof, are intended under normal use to last substantially longer than two years, the complaint period may be five years.

Where a complaint is accepted, the Seller shall cover the necessary costs of returning the goods or any other agreed solution. The buyer shall contact the Seller before returning the goods, unless otherwise agreed.

 

11. Privacy

The Seller processes personal data in accordance with applicable data protection legislation. Further information concerning the processing of personal data is provided in our privacy policy.

 

12. Dispute Resolution

The parties shall seek to resolve any disputes amicably. If this is unsuccessful, the buyer may contact the Norwegian Consumer Council (*Forbrukerrådet*) for guidance or mediation. Disputes shall be governed by Norwegian law.
